Immigration (Enhanced Risk Management) Amendment Bill 2026

To: Education and Workforce Select Committee
Date: April 2026

Purpose

The purpose of this submission was to oppose the Immigration Amendment Bill on the basis that it would disproportionately and adversely impact on disabled refugees and migrants through:

1. Restricting the right of all temporary visa holders, including disabled migrant visa holders, to appeal to the Immigration and Protection Tribunal.

2. Increase the deportation liability period during which permanent residents can be deported for breaching residency conditions from 10 to 20 years.

3. Extending the powers of Immigration NZ officers to conduct migration document checks.

4. Make it easier for Immigration NZ to deport migrants by claiming fraud even if they make honest mistakes, including if they mistakenly fill out details on a document.

5. Tightening restrictions on asylum seekers.
